PRE-CONTRACTUAL INFORMATION - GENERAL CONDITIONS OF SALE

The following general conditions of sale and use (hereinafter “General Conditions”) govern access to the www.bellevie.it (hereinafter referred to as “Site”)  and its use apply to all sales (hereinafter referred to as “Services”) provided by Belle Vie via Tosco Romagnola Est 40 56020. The use of the Services is allowed only to a registered user who:

a) is the consumer natural person where consumer means the natural person acting for purposes unrelated to the company business, commercial, artisan or professional activity eventually carried out

b) has come of age or, if he has already reached the age of 16, has received consent from his parents

c) has read the Privacy Policy relating to the processing of personal data

d) has accepted these General Conditions.

  1. Object and scope of application

These General Conditions apply to the Services provided by Belle Vie on the Site. Any new services shall be subject to these General Conditions, unless otherwise stated by Belle Vie.

The offer and sale on the Site constitute a distance contract governed by articles 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”) and by Legislative Decree no. 70 of 9 April 2003, containing the regulations on electronic commerce.

Belle Vie reserves the right to update or modify these General Conditions at any time, it being understood that for each purchase contract the General Conditions published at the time of sending the purchase order shall apply. To this end, the user is invited to save a copy of the General Conditions from time to time.

If the user does not intend to accept the changes to the General Conditions, he may withdraw by giving 7 days’ notice by e-mail. The continuous use of the Services, once this term has expired, as well as the electronic transmission of the order form by the user, constitutes an implicit manifestation of willingness to accept the General Conditions.

  1. How to register

To use the Services it is not necessary to be registered on the Site but it is necessary to approve the General Conditions by clicking on the appropriate icon. Failure to accept the General Conditions has, as a consequence, the impossibility of making purchases.

If the user is interested in registering on the Site, he/she must create an account and approve the General Conditions by clicking on the appropriate icon. Failure to accept the General Conditions will make it impossible to register as a user and make purchases.

Registration on the Site is free of charge. The user declares that the data provided when registering on the Site are correct, complete and true. When registering, the user must also enter a password of his/her choice. Registration will be confirmed by e-mail to the address indicated by the user at the time of registration. The user guarantees that the password for access to the Site will be used exclusively by the user himself and will not be given to third parties. Should the user become aware of undue use of the password by any third party, he/she must immediately notify Belle Vie by sending an e-mail to the following address bellevie@bellevie.it and, in any case, he/she may change the same at any time by entering the section of the Site My Account

Please note that the data entered at the time of order and registration will be processed in accordance with the provisions of current legislation on privacy. Please refer to the Privacy Policy

Belle Vie reserves the right to refuse, at its sole discretion, registration to the Site as well as the right not to accept orders if they are abnormal in relation to the quantity of products purchased or from subjects with whom a dispute is in progress.

  1. Pre-contractual information

In compliance with Legislative Decree No. 70 of 9 April 2003, containing provisions on electronic commerce, Belle Vie informs the user that:

– in order to conclude the contract for the purchase of one or more products on the Site, the user shall fill in an electronic order form by entering all his/her data (the user declares that the data provided at the time of ordering are correct, complete and true);

– the user will be able to verify and correct any data entry errors before sending the order;

– the contract is concluded when Belle Vie registers the order form, after verifying the correctness of the order data and payment;

– once the order form has been registered, the user will receive a confirmation e-mail from Belle Vie containing the link to the General Conditions, information regarding the characteristics of the product purchased, the detailed indication of the price, the means of payment used and the procedures for exercising the right of withdrawal. It is suggested to keep this e-mail as proof of purchase or to store it on a durable medium;

– the order form will be stored by Belle Vie in its database for the time necessary to process the order and, in any case, within the terms of the law and during this period it may be consulted by the user.

  1. Terms and conditions of purchase

The sales price, indicated in the description of each product, is expressed in Euro / € and is inclusive of VAT. Except where expressly indicated, no payment, delivery charges or other costs are due. The price indicated at the time of purchase is not subject to change.

The price that will be charged to the user is that present on the Site at the time the order is sent.

The products will become the property of the user upon payment of the price by the latter.

Belle Vie reserves the right not to confirm orders from Customers with whom disputes are pending.

Belle Vie will process the purchase order only after having received confirmation of authorization to pay the total amount due, consisting of the purchase price and any additional costs, as indicated in the order form.

  1. Methods of payment

Payments can be made:

– online by credit/debit card or PayPal account;

The credit card will only be debited once the details of the credit card used for the payment have been verified and authorisation to debit has been issued by the credit card company.

Each time the user is interested in receiving the invoice, the same must be requested at the time of the order by filling in the appropriate field.

  1. Delivery methods and times

Deliveries will be made to the address indicated by the user in the order form. Delivery times are those indicated on the order form and confirmed in the order confirmation.  As soon as the shipment has left, the user will receive an email containing the courier’s tracking to allow the user to keep track of the shipment.

If the delivery time is not indicated, the products will be delivered in the Italian territory within 48 hours or 3 (three) working days for the islands and outside the Italian territory within 5 (five) working days from the receipt of the order confirmation by the user.

Shipping is free for all orders.

The transport is entrusted on the Italian territory to GLS and outside the Italian territory to DHL. In any case It Shop . is not responsible for any delays due to the courier. The transport is NOT covered by full insurance against theft and/or loss.

IMPORTANT: in order to have a timely and safe delivery it is necessary for the user to indicate the destination address as accurately as possible, providing, in addition to the full address, all useful information, for example stairs, internal numbers, intercom number, etc.., also always indicating a telephone number where the courier can contact the user before delivery. Belle Vie . is not responsible for any delays and/or non-delivery caused by incomplete addresses or not adequately provided during the order process. Any delays will not give the purchaser any right to claim damages of any kind. For any problem Belle Vie . is available to resolve any disputes with the courier.

In case of non-delivery due to absence of the recipient, the courier will leave the coupon and the collection must be made within 3 (three) days from the second delivery attempt. For any need the user must send an e-mail to the following address customercare@bellevie.it.

  1. Execution of the service and refund

With the conclusion of the contract, i.e. with the payment of the price, Belle Vie undertakes to perform the services requested.

Should Belle Vie not be able to send the purchased product, it will promptly inform the user, who will be entitled to a full refund of the payment made within 7 (seven) days from the sending of the communication, excluding any further right by the user to refunds and compensation.

  1. Right of withdrawal

According to the Consumer Code, the consumer user has the right to withdraw from the contract without penalty within 14 (fourteen) days from the day of receipt of the products purchased on the Site. In this case the user will receive a full refund of the price of the products purchased as indicated below, minus the shipping costs for products not coming from Italy.

The withdrawal must be communicated, within the above term, by writing to bellevie@bellevie.it.

In order to return the products to Belle Vie ., the user must deliver them to the courier authorised for shipment within 14 (fourteen) days from when he received the products, in the same conditions in which he received them. Return expenses will be charged to the user only for returns not coming from Italy. The authorised couriers are the following: GLS for shipments coming from the Italian territory and DHL for shipments coming from outside the Italian territory.

The user is obliged to take care of the products while they are in his possession; in default, Belle Vie . will have the possibility to contest the refund request.

Below are all the steps that must be taken by the user to exercise his right of withdrawal:

  1. within 14 (fourteen) days from receipt of the products, the user must send an e-mail to bellevie@bellevie.it with the intention of returning the products;
  2. the products must not have been used, worn or damaged and must be returned in their original packaging and properly packaged for safe shipping;
  3. the returned products must be delivered to the authorised freight forwarder within fourteen (14) days from the date on which the user received the products.

Once the order has been cancelled within the term and according to the above mentioned procedures and only after the return of the product or only after having verified that the user has returned the goods, Belle Vie . will refund the returned goods as soon as possible and in any case within 5 (five) working days. The user will be refunded by Belle Vie . the full price minus the return costs if not coming from the Italian territory.  The amount will be credited to the same means of payment used for the purchase, unless another method has been agreed with the user.

  1. Warranty and return procedure in case of non-compliant product

In the event of a defective or damaged product, the user must notify Belle Vie of any problem or defect within sixty (60) days of its discovery by sending an email to the following address bellevie@bellevie.it indicating the reason and attaching photographs.

Within 5 (five) working days Belle Vie will authorize the return of the product and, within the following 30 (thirty) working days from the receipt of the product, Belle Vie will express its opinion on the defect or problem of the product. In case of acceptance of the warranty, the user is entitled to repair or replacement without any additional cost provided that Belle Vie still has the product available or that the repair is not excessively expensive in relation to the value of the product itself. Otherwise, the user is entitled to termination of the contract and therefore to a refund of the price or a reduction of the price itself if he decides to keep the product. Please remember that it is necessary to return the products in the same conditions in which they were received and using the following authorised couriers: GLS for shipments coming from the Italian territory and DHL for shipments coming from outside the Italian territory.

Methods for returning non-compliant products:

  1. the user must notify the request in writing as soon as possible and in any case within 30 (thirty) days of receipt of the product, by sending an email to the following address bellevie@bellevie.itindicating the reason and attaching the relevant photographs. It is advisable to keep a copy of this request;
  2. the products must be returned in their original packaging and properly packaged for safe shipping;
  3. the returned products must be delivered to the authorised freight forwarder within 7 (seven) days from the date on which the user has informed Belle Vie that the product is damaged or defective due to Belle Vie itself.

In case Belle Vie does not acknowledge its responsibility for damage of the returned product, it will send a notification that the returned product cannot be accepted. In this case the user may request that the defective or damaged product be sent back to him/her.

If the recipient of the product indicated in the order form is different from the person who made the payment for that product, the amount paid for the returned item will be refunded by Belle Vie to the person who made the payment. The value date for the credit will necessarily also be the same as the value date of the original debit to avoid any loss of interest. The refund will be made using the same payment method used for the purchase.

Belle Vie will not be responsible for any delay independent of its will, including delays caused by the purchase or refund method, including, for example, delays caused by the refund policies of each credit institution.

  1. Site content and intellectual property

The graphic representation of the Site, the texts, images and all software compilations, the source code, the software itself as well as any material on the Site are the exclusive property of Belle Vie .. All rights are reserved. The user is entitled to make a paper or electronic copy of portions of the Site for the sole purpose of purchasing a product represented on the Site. The reproduction, modification, duplication, copying, distribution, sale or in any case the exploitation of the images, the contents of the Site is forbidden unless previously authorised in writing by Belle Vie .. Any use of the contents of the Site for commercial and/or advertising purposes is also prohibited.

  1. Applicable law and competent court

These General Conditions are governed by the Consumer Code and Legislative Decree no. 70 of 9 April 2003 on electronic commerce. The Contract shall be governed by and interpreted in accordance with Italian Law.

For the resolution of any civil disputes arising from the interpretation, execution and termination of this Contract, for the consumer user the mandatory territorial jurisdiction shall be the court of the place of residence or domicile of the consumer himself, if located in Italy. For other users it is the Court of Pisa.

For the sake of completeness, the user is informed that in case of dispute it is possible to file a complaint pursuant to art. 14 of the Regulation 524/2013 through the ODR platform of the European Union, which can be reached at the following link http://ec.europa.eu/consumers/odr/. The ODR platform constitutes an access point for users who are willing to resolve disputes arising from contracts of sale or online services in an extra-judicial context.
